Addressing the Earned Settlement proposal (CP1448).
Summary
This publication sets out the founding position of Skilled Worker Justice Alliance (SWJA) in relation to the Earned Settlement proposal and CP1448. It records the reliance placed by existing Skilled Worker visa holders on the published five-year pathway to settlement and identifies the distinction between prospective reform and retrospective settlement change as central to transitional fairness. The paper concerns proposals that would extend settlement qualifying periods, attach additional conditions to progression or alter rights after indefinite leave to remain where those changes affect people already progressing within the route. It frames the issue through legal certainty, reliance interests, transitional protection and the need for a structured evidence base on the position of existing Skilled Worker pathways.
